CRIF High Mark - Credit Score Terms of Use

In connection with the submission of the application for my credit information (“Consumer Credit Information”) offered by CRIF High Mark Credit Information Services Pvt. Ltd. (“CIC”) through Choice Finance Ltd. (the “Company”) and the delivery of my Consumer Credit Information to the Company, I hereby acknowledge and agree to the following:

1. The Company is my lawfully appointed agent and has agreed to obtain my Credit Information Report and Credit Score from CRIF High Mark Credit Information Services Pvt. Ltd. (CRIF High Mark) solely for the purpose of ____________________ and for no other reason.
2. This consent shall remain valid for a maximum period of six (6) months or until such time the credit information is required to fulfil the intended purpose, unless I withdraw my consent earlier by informing the Company through their registered office address, website, designated email ID, or mobile application.
3. I authorize the Company to share my personal information with CICs on a monthly basis for the purpose of procuring my Credit Information and providing me the said service (“Purpose”).
4. I confirm that this consent is given voluntarily and is not influenced by any solicitation from any person or entity.
5. I expressly authorize and direct CIC to deliver and/or transfer my Consumer Credit Information to the Company on my behalf.
6. I shall not hold CIC responsible or liable for any loss, claim, liability, or damage arising out of: (a) the delivery of my Consumer Credit Information to the Company; (b) any use, modification, or disclosure of my information by the Company, where authorized by me; (c) any breach of confidentiality or privacy during transmission of my information to the Company.
7. I acknowledge that (a) CIC has not made any representations or promises to induce me to provide my Consumer Credit Information or consent; and (b) the implementation of the agreement between CIC and the Company is solely the responsibility of the Company.
8. I understand that I may be required to provide consent electronically or physically. By clicking “I Accept” or by signing this consent physically, I provide written instructions to the Company authorizing them to obtain my Consumer Credit Information from CRIF High Mark for identity verification and for displaying the information to me. I also acknowledge receiving and agreeing to CIC’s privacy policy.
9. I authorize the Company to obtain my Consumer Credit Information from CIC in order to deliver the product or service requested by me.
10. By submitting this registration form, I provide express written instructions to the Company to request and receive my credit report and score from CIC.
11. I understand that the product is provided on an “as-is” and “as available” basis and that CIC expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. I shall not initiate any claim or legal action against CIC and irrevocably release CIC, its officers, directors, employees, agents, licensees, affiliates, successors, and assigns (“Releasee”) from all liabilities, claims, suits, and expenses (“Losses”) arising from my submission of Consumer Credit Information or my authorization to deliver it to the Company. I agree to indemnify and hold the Releasee harmless from third-party claims related to this consent.
13. I agree that this confirmation letter shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts of Mumbai regarding any disputes arising hereunder.
